Quick answer

How much compensation will I get in Queensland?

It depends mainly on how serious your injuries are. As a general guide from AMK's experience, minor injury claims often fall around $30,000 to $80,000, moderate injuries around $80,000 to $200,000, and serious injuries above $200,000. These ranges are indicative only. Income loss, care needs and fault all change the outcome.

How Our Compensation Calculator Works

  1. Provide details. Tell us where and how you were injured, how serious your injuries are, and how they affect your work, care needs and medical costs.
  2. Get an estimate. The calculator gives you an indicative range based on the severity of your injuries, plus the factors in your answers that may increase your claim or need checking.
  3. Free consultation. If you want a firmer view, a lawyer reviews your answers and talks you through your options. There is no cost and no obligation.

What Affects How Much Compensation You Can Get In Queensland

Severity of injury. This is the biggest single factor. Injuries that need surgery, leave permanent impairment or stop you working are generally worth far more than soft tissue injuries that heal within months.

Lost income, now and in the future. If your injuries reduce your hours, force a change of job or stop you working, that loss can be claimed, and future loss is often the largest part of a serious claim.

Care and assistance. Help you need at home, whether paid or provided by family, can form part of a claim.

Medical and treatment costs. Past and future treatment, medication and rehabilitation costs are recoverable in many claims.

Fault. Common law damages depend on someone else being at fault, such as another driver, an employer or the occupier of a property. Some schemes, like WorkCover statutory benefits, are paid regardless of fault.

Time limits. Strict deadlines apply. A strong claim can be lost simply because it was started too late.

CTP, WorkCover And Public Liability: Different Schemes, Different Rules

Car and road accidents (CTP). Claims are made against the compulsory third party insurer of the vehicle at fault. Notice should be given within 28 days of the accident.

Workplace injuries (WorkCover). Lodge your WorkCover claim within 6 months. A statutory lump sum is offered when your degree of permanent impairment (DPI) is assessed at 1% or more. If your DPI is under 20%, or you have none, you must choose between that lump sum and a common law claim, so get advice before accepting. For injuries on or after 31 January 2015 there is no minimum impairment level for a common law claim.

Public places (public liability). Injuries in shops, on council land and other public places generally carry a 3-year limitation period, and evidence such as CCTV should be secured quickly.

Compensation Calculator FAQs

Is the compensation calculator accurate?

It gives an indicative range based on the severity of your injuries, drawn from AMK's general experience across claims. It is not legal advice or a guarantee. Every claim is assessed on its own facts, and a lawyer can give you a firmer view for free.

Is the calculator free?

Yes. The calculator is free, you see your estimate without entering contact details, and a follow-up consultation is also free with no obligation.

Does it work for CTP, WorkCover and public liability claims?

Yes. It covers car and road accidents, workplace injuries and injuries in public places. Each scheme has different rules, which is why the result flags anything that needs checking, such as a WorkCover lump sum offer.

What if my accident was more than 3 years ago?

Time limits may have passed, but there can be exceptions. Call us as soon as possible so a lawyer can check your dates before you rule anything out.

Will using the calculator commit me to anything?

No. Using the calculator does not start a claim or commit you to anything. If you choose to send your details, a lawyer will contact you for a free, no-obligation chat.

How is pain and suffering calculated?

Pain and suffering, often called general damages, depends on the type and severity of your injuries and their lasting effect on your life. In Queensland it is assessed under set rules rather than a simple formula, so a lawyer needs to review your medical evidence to estimate it properly.

I can't believe how lucky I was

"I truly believe that if it was not for Michael and his team at AMK Compensation Lawyers, I might not be here writing this review today. Michael is an incredibly smart man and has worked as a defence lawyer for the insurers before starting his own firm. He foresaw and knew every tactic they used before they used it. To this day I am still blown away how Michael and AMK Compensation Lawyers got the insurer to a really good settlement when I was backed into a corner. I am forever grateful."
