Do I have a compensation claim?

If your injury was caused or contributed to by someone else's negligence — a driver, employer, business, property owner or health provider — you likely have a claim. The fastest way to find out is our free claim check. There is no cost and no obligation.

What is No Win No Fee and what does it actually cost?

No Win No Fee means you pay nothing upfront and nothing if your claim is unsuccessful. All disbursements — medical reports, expert evidence, court filing fees — are funded by AMK and recovered only from your settlement. How long do I have to make a claim in Queensland?

Time limits vary by claim type. CTP motor vehicle accident claims require notification within 28 days. WorkCover claims must be lodged within 6 months of injury. Common law personal injury claims generally have a 3-year limitation period. Hit-and-run Nominal Defendant claims require notice within 3 months. How much is my claim worth?

Compensation is calculated on pain and suffering, loss of earnings (past and future), medical and rehabilitation expenses, and care costs. The amount depends on the severity of your injury, your age, and your occupation. AMK will give you a realistic range at your free initial consultation.

How long does a compensation claim take?

Most claims resolve within 12 to 18 months once your injuries have stabilised. Complex claims or matters that proceed to court can take longer. AMK will give you a realistic timeline at your first consultation and update you throughout.

Can I claim if I was partly at fault?

Yes, in most cases. Queensland's contributory negligence rules allow you to claim even if you contributed to your own injury. Your compensation may be reduced proportionally to your degree of fault, but you are not automatically barred from claiming.

Do I need to go to court?

The vast majority of claims — over 95% — settle before reaching court. AMK prepares every file as though it will proceed to court, which puts you in the strongest possible negotiating position.

What is CTP insurance and who can claim?

Compulsory Third Party (CTP) insurance is included in every Queensland vehicle's registration and covers compensation for people injured in motor vehicle accidents — drivers, passengers, cyclists and pedestrians. You can claim statutory benefits even if you were at fault. If another party was at fault, you may also claim common law damages. See our CTP claim guide.

What is the difference between a WorkCover claim and a common law claim?

A WorkCover statutory claim provides weekly wage replacement and medical expenses regardless of fault. A common law claim is available where your employer's negligence contributed to your injury and can deliver significantly higher compensation — including damages for pain and suffering and future economic loss. What is a public liability claim?

A public liability claim is made when a business, landowner or council fails to maintain safe premises and you are injured as a result — for example, a slip and fall at a shopping centre, restaurant or public park. What is a TPD claim?

Total and Permanent Disability (TPD) insurance pays a lump sum if you are permanently disabled and unable to return to your usual occupation. Most Australians have TPD cover inside their superannuation fund without realising it. AMK provides a free policy check and pursues claims on a No Win No Fee basis.
