What Is A CTP Claim?

A CTP claim is a compensation claim against the Compulsory Third Party insurer of an at-fault driver. Every registered Queensland vehicle carries CTP insurance, and it covers anyone the driver injures — passengers, pedestrians, cyclists, motorcyclists and other drivers.

The scheme is fault-based and regulated by the Motor Accident Insurance Commission. You claim against the insurer, not the driver personally — so claiming against a friend or family member who was driving doesn't cost them anything.

How Is A CTP Payout Calculated In Queensland?

Your general damages are set by the Injury Scale Value (ISV) — a 0-to-100 scale fixed by regulation — while economic loss, care and medical expenses are assessed on your actual circumstances and evidence. Economic loss is usually the largest component by far.

What Are The CTP Claim Time Limits?

Accident Notification Form: 28 days for early treatment funding. Notice of Accident Claim Form: 9 months from the accident or first symptoms — or 1 month after first consulting a lawyer. Court proceedings: 3 years. Nominal Defendant claims: 3 months' notice.

The 9-month limit isn't always fatal — a reasonable excuse can save a late claim — but the Nominal Defendant deadlines for unidentified vehicles are close to absolute. When in doubt, notify first and argue later.

Who pays my CTP claim — the driver or the insurer?

The insurer. CTP exists precisely so injured people are compensated by an insurance scheme rather than chasing individuals. The at-fault driver's premiums don't even increase the way comprehensive insurance does.

Can I make a CTP claim as a motorcyclist or pillion?

Yes. Riders and pillion passengers injured by another driver's negligence claim like any other road user. Single-vehicle motorcycle accidents caused by road defects may instead be public liability claims against the road authority.

What is an Injury Scale Value (ISV)?

A number from 0 to 100 assigned to your injury under Queensland regulations, which fixes your general damages for pain and suffering. Multiple injuries are assessed together with possible uplifts — getting the dominant injury and uplift arguments right materially changes the award.

Does the CTP insurer pay my treatment while the claim runs?

Once liability is admitted, the insurer must fund reasonable and appropriate rehabilitation. Lodging the Accident Notification Form within 28 days unlocks early treatment funding even before liability is sorted.

What if the at-fault driver was drunk or unlicensed?

Your claim is unaffected — the CTP insurer still pays. The insurer may pursue the driver to recover its outlay, but that's their problem, not yours.
